Section 202A of the Employment Rights Act 2025 introduced a new carve-out preventing NDAs from stopping disclosures to legal advisers, trade union officials, or specified regulators about workplace conduct. Any employee NDA signed on or after April 2026 must include this carve-out to be fully compliant. NDASafe's Employee NDA was updated in June 2026 to reflect this change. If you are using a template from any provider, verify the last-reviewed date and confirm the ERA 2025 carve-out is present before use.
Frequently asked questions
Is Simply-Docs suitable for UK NDAs?
Simply-Docs offers a solid general NDA for standard UK business situations. It is best suited to users who already subscribe to their document library or who need a variety of business templates beyond NDAs. If you specifically need an employment, freelancer or investor NDA — where UK-specific statutory carve-outs (PIDA 1998, ERA 2025) and IR35-aware language are important — NDASafe's specialist templates are purpose-built for those scenarios.
What is the main difference between Simply-Docs and NDASafe for NDAs?
Simply-Docs is a broad legal document library; NDASafe is an NDA specialist. Simply-Docs serves users who want one platform for many document types. NDASafe serves users who need one of eight specifically UK-adapted NDA variants with the latest statutory carve-outs built in. Both deliver editable Word documents; the difference is depth of NDA specialisation.
Does Simply-Docs include the Employment Rights Act 2025 carve-out in its NDA?
Template libraries update at different rates. The Employment Rights Act 2025, in force from April 2026, added a new carve-out (s.202A) that prevents NDAs from stopping disclosures to a legal adviser, trade union official, or specified regulator about conduct in the workplace. NDASafe's Employee NDA was updated in June 2026 to include this carve-out. If you are using a Simply-Docs NDA in an employment context, check the template's last-reviewed date and verify the ERA 2025 carve-out is present before signing.
Which is better value — Simply-Docs or NDASafe?
It depends on your need. If you regularly require a broad range of business documents, Simply-Docs' library may offer better value overall. If you specifically need an NDA — or a set of NDA variants for different situations — NDASafe at £29 per template or £79 for all eight is typically more cost-effective than a subscription to a full document library you will only use for the NDA section.
Can I use an NDA from either service as a starting point and modify it myself?
Yes. Both Simply-Docs and NDASafe deliver editable Word documents intended for self-help use. NDASafe templates include inline guidance notes explaining each clause so you can make informed modifications. Neither service constitutes legal advice, and both recommend independent legal advice for high-value or complex arrangements.
